Identification<\/strong><\/h2>\n\n\n\n

In Latvia, the first responders nor the idea of a \u201cpresumed victim\u201d are not explicitly defined in the legislation or other regulations. In practice, the identification is done either by the State Police or service providers, such as Centre MARTA or Shelter \u201cSafe House\u201d. The process of identification of a child is similar to the general identification process for a victim of human trafficking in Latvia, with few exceptions.<\/p>\n\n\n\n

Early and immediate assistance<\/strong><\/strong><\/h2>\n\n\n\n

In Latvia, the assistance and services for victims of human trafficking is provided by specialized non-governmental service providers Centre MARTA or Shelter \u201cSafe House\u201d. After identification by the service provider, victims are entitled to receive social rehabilitation service for up to 180 days. The services are similar to all victims, including children who are furthermore entitled to education and other age-appropriate services.<\/p>\n\n\n\n

Temporary<\/strong><\/strong><\/strong> residence permits<\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n

Third country nationals who have been identified as victims of human trafficking may apply a temporary residence permit to extend their stay in Latvia. To receive a temporary residence permit, the victim must agree to cooperate with law enforcement authorities and be involved in the criminal procedure. The first permit is often given for one year with the possibility of extension.<\/p>\n\n\n\n

Pre-trial investigation and criminal proceedi<\/strong>ngs<\/h2>\n\n\n\n

In addition to the Social Rehabilitation Programme, victims have access to support services that are connected to the pretrial investigation or court proceedings. These services can include for instance psychosocial assistance and representation in court. Victims of an intentional criminal offence have the right to receive State compensation for moral injury, physical suffering or financial loss.<\/p>\n\n\n\n

Long-term assistance and residence permits <\/strong><\/h2>\n\n\n\n

In order to receive long-term assistance in Latvia, a victim of human trafficking must have legal grounds to stay in Latvia. After the reflection period and a temporary residence permit, the victim can seek a temporary residence permit on humanitarian grounds, seek for a work permit or visa, or become a citizen of Latvia through naturalization process.<\/p>\n\n\n\n

Voluntary return and reintegration<\/strong><\/strong><\/h2>\n\n\n\n

Victims that do not want to or cannot stay in Latvia, have the opportunity to use voluntary return programmes to return back to their country of origin. The programme in Latvia is offered by the International Organisation for Migration (IOM) and it is free of charge. A return can be also organized by the victim, without the assistance of IOM or state authorities.<\/p>\n\n\n\n
