Temporary residence permits
Victims of human trafficking, including undocumented victims, can have access to a temporary residence permit. The residence permit is connected to the cooperating with the law enforcement authorities in criminal proceedings.
A victim is eligible for a temporary residence permit if:
- They are willing to cooperate with state authorities
- They have severed all ties with the individuals accused of having committed the offence, and
- Their testimony is seen as necessary for criminal proceedings.
The length of the temporary residence permit depends on the expected length of the criminal proceedings. The residence permit is often granted for one year, with the possibility of extension. By the consideration of authorities, the residence permit can also be renewed after the finalisation of the criminal proceedings on humanitarian grounds. Victims who fear for their safety in their country of origin can apply for asylum or other residence permits.
Victims can work in Germany during the temporary residence permit.
