Temporary residence permits

After the reflection period has been exhausted, 3rd country nationals who have been identified as victims of human trafficking may apply a temporary residence permit to extend their stay in Latvia. The permit is issued by the Office for Migration and Citizenship Affairs.

To receive a temporary residence permit, the victim must agree to cooperate with law enforcement authorities and be involved in the criminal procedure. The temporary residence permit is usually given to the victim for the whole length of the criminal procedure, until a court decision is reached. The permit is not revoked if the criminal proceedings end before the expiry date of the residence permit. 

The first permit is often given for one year with the possibility of extension. Victims that receive the permit have the right to work in Latvia. 

Child victims of human trafficking must be represented by a legal guardian or representative. In other respects, the process is similar to adult victims. 

Victims can receive social rehabilitation services during the time the Office for Migration and Citizenship Affairs considers its decision.
