Temporary residence permits
If a victim of human trafficking does not have a permit to remain in Sweden, the leader of the preliminary investigation at the police or prosecution authority can apply for a temporary residence permit for the victim. The temporary residence permit is given initially for six months and can be extended to cover the duration of the preliminary investigation and criminal proceedings.
The application for the permit can be made when the reflection period expires, or earlier if the necessary conditions are met. The Swedish Migration Agency will grant a temporary residence permit if the following conditions are fulfilled:
- The victim has clearly demonstrated their intention to cooperate with the investigating authorities
- A preliminary investigation or a main hearing in a criminal case must be in place
- The victim has broken off all contact with the persons suspected of perpetrating the crime in question
- Considerations for public order and safety do not indicate that a permit should not be issued
The permit does not create a basis for a permanent residence permit.
The temporary residence permit allows victims to access the labour market as well as vocational training and education. In addition, victims are entitled to the same health and medical care that is offered to those residing in the county.

Children
Children who hold a temporary residence permit have the right to free basic education in Swedish public schools. However, they are not subject to the compulsory schooling requirement.
Social services have a special responsibility to provide support and protection regardless of the child’s legal status. The municipality is also obliged to offer these children access to preschool. The municipality may then apply to the Swedish Migration Agency to recover the cost of these services.
